Quinky Terms of Service
These Terms of Service (Terms) are a legally binding contract between you and The Quinky Company (“The Company”, “Quinky” or “We”/”Us”). If you do not accept these Terms, you must not use the Service.
By using QuinkyPeople.com (“The Site” or “The Service”), you:
Agree to accept these terms and all associated policies and procedures in their entirety.
Agree to follow all community guidelines and acceptable use policies.
Certify that you are eligible to use The Service.
Certify that all representations you make are true.

1. Eligibility
You may not use the Service unless you meet certain criteria.
A. This Service is for consenting adults only. In addition, the following may not use the Service under any circumstances:
Minors
Sex offenders
Previously banned users
Journalists acting in a professional capacity
Persons in countries where adult material is prohibited
Persons in countries sanctioned by the United States of America.
B. Everyone using the Service must provide verification of their age and identity and valid contact information. Sharing of credentials or signing up using someone else’s credentials is strictly prohibited.
C. Access to the Service is at our sole discretion. We reserve the right to suspend, restrict or terminate accounts at any time.

2. Use of the Service
We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service, subject to these Terms and the following restrictions in particular:
A. You may not use the Service for any illegal purposes.
B. You may not copy, resell, download or share any material on the Site, except as permitted by the content owner.
C. You must not attempt to harm or damage the Service in any way.
D. We reserve the right to suspend or modify the Service at any time.
E. You give us the right to use anything you post in order to operate the Service. (This does not give us ownership over your content: it simply allows us to store it and display it to other users.)

3. Your data
In order to operate the Service, we need to hold some details about you.
A. We hold personally identifiable data in accordance with our Privacy Policy.
B. We use cookies. You can control what cookies to accept, as laid out in our Cookie Policy.
C. You may request the deletion of your account. However, we may be required to retain some data for legal reasons.
4. Acceptable use
All users of the Service are required to abide by our community guidelines.
A. The following activities are explicitly prohibited:
Child sexual abuse material (real or simulated)
Using the Service for prostitution or sex trafficking
The depiction of certain activities (real or simulated), such as rape, torture, bestiality, or incest
The sale of certain items, such as drugs or weapons
The sale of counterfeit goods
The use of AI-generated avatars, videos, or imagery
Hate speech, harassment, defamation, doxing, discrimination, or other forms of abuse
B. We reserve the right to moderate the Service as we see fit. This may include:
Removal of content
Removal of items from sale
Restriction, suspension or termination of user accounts

5. Payments and purchases
Goods and services are offered for sale subject to the following conditions.
A. You understand that all purchases are between buyer and seller. Prices, shipping options and cancellation terms are set by the seller, not by us. We are not responsible for:
Timely fulfilment of orders.
Correct fulfilment of orders.
Loss or damage to goods in transit.
B. Purchasers and sellers should attempt to resolve disputes directly in the first instance. If you cannot come to a satisfactory resolution, please contact support@quinkypeople.com.
C. If you purchase a subscription, your payment method will be charged until you cancel it. If you are paying for a subscription via your Wallet, your Wallet will be charged until all funds are used. If your payment method fails, we may cancel your subscription.
D. Depending on the nature of the goods or services being purchased, it may or may not be possible to obtain a refund or replacement, or to cancel an order once placed. In general, all purchases of digital goods, including live streams and tips, are final. Purchases of physical goods cannot be canceled once shipped. In the case of custom items, the seller may reserve the right to disallow the cancellation of an order once they have started work on it.
E. You agree not to initiate chargebacks. Initiating a chargeback for any order placed by you will be treated as fraud and may be referred to law enforcement. If you believe a charge is fraudulent or you want a refund, please contact support@quinkypeople.com.
F. You are solely responsible for ensuring that anything you purchase on the Service is legal in your place of residence. We are not responsible for any legal consequences that may result from your possession or purchase of physical or digital goods or services offered on the Service. We are not responsible for items that are delayed, returned or confiscated by Customs or other authorities.
G. You may be liable for tariffs or import duties in addition to the sale and shipping cost.
H. All purchases must be made through the Service. Buyers must not circumvent our payment systems and purchase directly from sellers.

6. Sellers, performers and vendors
If you wish to sell goods or services on The Service, you agree to the following terms.
A. You agree that this is a curated service. We reserve the right to determine in our sole discretion what may or may not be offered on the Site.
B. You must abide by the Prohibited Items Policy and Prohibited Activities Policy.
C. Performers in adult content must provide proof of age and consent from all participants, using form USC 2257 and the appropriate consent forms. Refer to our Consent Policy.
D. You agree to respect our rules for
Providing up to date and accurate information to purchasers
Fulfilling orders in a timely manner
Shipping goods in an appropriate manner
Offering cancellations, refunds or replacements
Addressing buyer concerns in a timely and respectful manner
E. You must not attempt to circumvent our payment systems and offer goods or services directly to buyers or direct them to another site.
F. You are responsible for determining whether to collect state taxes, tariffs, or other fees. We may provide tools to assist you with this decision, but it is your responsibility to assess your liabilities.
G. You accept full liability for the quality and legality of all goods and services you offer. If you wish to supply goods and services outside your home state or country, you are responsible for determining whether that is legal.
H. Payments for goods and services will be made in accordance with our Payment Policy.

7. Violations & reporting
We will act to ensure that users adhere to these Terms.
A. You must immediately notify us of any violations of these Terms, particularly where they involve CSAM, prostitution, sex trafficking, or other illegal activity. We may refer suspected illegal activity to law enforcement.
B. We respect copyright and the Digital Millenium Copyright Act (DMCA). To initiate a DMCA takedown, see our DMCA Policy.
C. To report a violation, contact support@quinkypeople.com and include detailed information on the suspected violation, including URLs and screenshots. We will normally respond within three business days.
D. We reserve the right to use automated tools or human moderators to identify violations.
E. We will take whatever action we believe necessary to address violations, as per our Moderation Policy and Customer Dispute Policy. You agree to abide by our decisions. If you disagree with our decision, you may appeal.
8. Warranties, liabilities, indemnification and disclaimers
You agree that there are limits to our responsibility, and that you take sole responsibility for everything you do on the Service.
A. Your use of the Service is entirely at your own risk.
B. The Service and Site are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee uninterrupted or error-free operation, protection against unauthorized access, or that any defects will be corrected. We may review, moderate, or remove content at our discretion, but we are not obligated to do so.
C. To the maximum extent permitted, we are not liable for losses or damages arising from or related to:
user disputes;
actions of other users or third parties
content errors or omissions;
unauthorized access to or use of accounts or data;
any interruption or cessation of transmission;
bugs, viruses, or similar harm transmitted by third parties;
actions or inactions of payment or payout processors;
actions taken to enforce these Terms
events beyond our reasonable control.
E. If you are dissatisfied with the Service or have any complaint, your sole and exclusive remedy is to stop using the Service or to submit a complaint through the procedures provided below. In all cases, the maximum liability of the Company will not exceed the greater of $100 USD or the amount you paid to the Company for the specific purchase giving rise to the claim.
F. You understand that you are solely responsible for all content you post on the Service, including private messaging, and for all items you offer for sale. You agree that you have the legal rights to everything you post.
G. You agree to indemnify, defend, and hold harmless the Company from and against any and all claims, losses, or liabilities (including reasonable attorneys’ fees) arising out of or related to your access to or use of, or conduct on the Service.

9. Disputes & arbitration
If you have a dispute with us, you must address it in the following manner.
A. You must first attempt to resolve the dispute informally in good faith. You must notify us of the issue by contacting support@quinkypeople.com in a timely manner.
B. If we are unable to resolve the dispute to our mutual satisfaction, you agree to arbitration.

10. Miscellaneous
The following terms also apply.
A. Entire Agreement: These Terms, along with any incorporated policies, constitute the entire agreement between you and the Company regarding the Service and supersede all prior understandings.
B. Assignment and Delegation: You may not assign or transfer your rights or obligations without our prior written consent. We may assign these Terms or delegate obligations in connection with a merger, acquisition, financing, or sale of assets.
C. No Waivers: A failure to enforce any provision is not a waiver of the right to enforce it later.
D. Severability: The parties intend as follows:
that if any provision of these Terms is held to be unenforceable, then that provision will be modified to the minimum extent necessary to make it enforceable, unless that modification is not permitted by law, in which case that provision will be disregarded;
that if modifying or disregarding the unenforceable provision would result in failure of an essential purpose of this agreement, these Terms will be held unenforceable;
that if an unenforceable provision is modified or disregarded in accordance with this section, then the rest of these Terms will remain in effect as written; and
that any unenforceable provision will remain as written in any circumstances other than those in which the provision is held to be unenforceable.
E. Notices (To the Company / To You): You may send legal notices to legal@quinkypeople.com and general support inquiries to support@quinkypeople.com. We may provide notices via email to the address in your account, through in‑product messaging, or by posting to the Service. Notices are deemed received when sent (for email) or when posted (for in‑product or website postings).
F. Force Majeure: We are not responsible for delays or failures caused by events beyond our reasonable control (e.g., acts of God, labor disputes, power or internet failures, cyberattacks, epidemics, war, civil unrest, governmental actions).
G. No Third‑Party Beneficiaries: These Terms do not create any third‑party beneficiary rights.
H. Relationship of the Parties: These Terms do not, and the parties do not intend it to, create a partnership, joint venture, agency, franchise, or employment relationship between the parties and the parties expressly disclaim the existence of any of these relationships between them. Neither of the parties is the agent for the other, and neither party has the right to bind the other on any agreement with a third party.
I. Successors and Assigns: These Terms bind and benefit the parties and their lawful successors and permitted assigns.
J. Communication Preferences: By using the Service, you consent to receive electronic communications. You may opt out of marketing emails by following the unsubscribe link. Adult content may be explicit.
K. Electronic Communications Not Private: We may access, preserve, and disclose information as required by law or to protect the Service and users, consistent with our Privacy Policy.
L. Electronic Signatures: You agree to the use of electronic signatures and records and to transact electronically.
M. California Consumer Rights Information: Under California Civil Code § 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N‑112, Sacramento, CA 95834, or by telephone at (800) 952‑5210.
N. English Language: These Terms are in English; translations, if provided, are for convenience only. In the event of a conflict, the English version controls.
O. Export Controls: You represent that you are not located in, under the control of, or a national or resident of any embargoed country or on any U.S. government denied‑party list, and you will not export or re‑export the Service or any related software or technical data in violation of U.S. or other applicable export laws.
P. Submission of Ideas: We welcome suggestions but do not accept them in confidence. By submitting ideas (including feature requests, translations, or content like glossaries), you grant us a perpetual, irrevocable, worldwide, royalty‑free license to use and exploit them without obligation or attribution. You represent that submitted ideas are your original work and do not infringe others’ rights.
Q. Modification of Terms: We reserve the right to change these Terms and associated policies or procedures from time to time with or without prior notification.
